1. scope

The following General Terms and Conditions apply to all business relationships between QUADRO DER GROSSBAUKASTEN GMBH and end consumers. The version valid at the time of the conclusion of the contract is decisive in each case. Customers in the sense of these terms and conditions are consumers.

A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.

Deviating conflicting or supplementary general terms and conditions shall not become part of the contract even if known, unless their validity is expressly agreed in writing. The law of the Federal Republic of Germany shall apply.

2. conclusion of contract

The products posted in the QUADRO online store do not represent binding offers, but a non-binding invitation to the customer to order. Conditions of the posted goods are subject to change and non-binding.
With the order, the customer submits his legally binding offer. QUADRO DER GROSSBAUKASTEN GMBH will confirm receipt of the customer's order directly. This confirmation does not yet represent a binding acceptance of the order. This confirmation only represents a declaration of acceptance if QUADRO DER GROSSBAUKASTEN GMBH expressly declares this. Telephone orders do not represent a binding acceptance by QUADRO DER GROSSBAUKASTEN GMBH. This is only done by sending an order confirmation in text form (email, fax, letter).
The QUADRO DER GROSSBAUKASTEN GMBH is entitled to accept the offer in the form of an order within 3 working days from receipt. The QUADRO DER GROSSBAUKASTEN GMBH is entitled to reject the acceptance. The QUADRO DER GROSSBAUKASTEN GMBH is entitled to limit orders to a household quantity.
In the case of orders placed electronically, the text of the contract will be stored by QUADRO DER GROSSBAUKASTEN GMBH and transmitted to the customer in text form (e-mail, fax, letter) after the order has been sent, including the legally effective General Terms and Conditions.

3. retention of title

If QUADRO DER GROSSBAUKASTEN GMBH makes advance payment, the goods remain the property of the seller until full payment has been made.
For the period of retention of title, the customer undertakes to treat the goods with care and to inform QUADRO DER GROSSBAUKASTEN GMBH immediately in writing of any access by third parties, in particular of enforcement measures, damage or destruction.

4. prices

The prices stated in the QUADRO online store are binding. The stated prices include the statutory value added tax. In the case of mail order sales, the prices are exclusive of a flat shipping charge. The shipping costs can be found under point 6 of these GTC.

5. payment methods

Payment can be made by credit card, PayPal or voucher.

Credit card: Your credit card will be charged upon completion of the order.
PayPalIf you select this payment method , you will be redirected to PayPal. Once the required data has been entered there, it automatically goes back to the QUADRO online store to complete the order.
PayPal Installment payment: If you select this payment method, the next step is to be redirected to PayPal. Once the required data has been entered there, it automatically goes back to the QUADRO online store to complete the order.

6. shipping costs

The purchase prices are plus freight costs. Additional delivery and shipping costs are therefore incurred for shipping. The amount of the additional delivery and shipping costs depends on the information provided in the online store.

7. delivery time

Please refer to the article overview for exact delivery time details. The delivery times for shipments abroad may be extended.
Please note that all packages of orders with multiple items are handed over to the shipping company at the same time. However, during delivery it may occasionally happen that not all packages arrive at the same time. This happens very often, for example, with orders that include a slide or individual parts.
The period for delivery begins when paying in advance on the day after the payment order is issued to the remitting credit institution. For other payment methods, the period begins on the day after conclusion of the contract and ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday or a public holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day.

8. packing stations

Deliveries to packing stations are not possible.

9. guarantee/warranty

Consumers can choose whether the subsequent performance is to be carried out by rectification of defects or replacement delivery. QUADRO DER GROSSBAUKASTEN GMBH reserves the right to refuse the type of subsequent performance chosen if this is only associated with disproportionate costs and the other type of subsequent performance has no significant disadvantages for the consumer.
For consumers, the statutory warranty period is two years from delivery of the goods.
In the case of used goods, the warranty period may be shorter than two years.
In addition to the warranty, QUADRO DER GROSSBAUKASTEN GMBH grants consumers a warranty limited to six years from receipt of the goods. Excluded from this are the arch slide, modular slide, textiles, pool foils / covers and nets. The legal rights, such as the statutory warranty right, right of withdrawal for consumers or general statutory claims for damages, are not limited by the warranty. The warranty is not transferable and is valid exclusively within the country in which the goods were delivered to the consumer.
If QUADRO DER GROSSBAUKASTEN GMBH recognizes defects, costs arising from repatriation are not covered by this warranty.
Not covered by the warranty are
- Damage due to improper handling,
- Damage due to incorrect assembly,
- Damage due to improper storage,
- Damage due to natural wear and tear, overloading,
- Damage due to the use of accessories/additions/attachments and care products not approved by the manufacturer,
- Damage caused by external influences or events such as storm damage, flood damage or tap water damage
- Consequential damage that does not occur to the object of sale
- Minor defects that do not significantly affect the value or use of the item
- Personal injury
Warranty services will only be provided if the customer within the warranty period
- a copy of the invoice or the transmitted order confirmation and
- submits photos of the defects of the purchased item. This can be done by e-mail or in writing.

10. transport damage

If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the transport company or the transport insurance.

11. contract language

The language available for the conclusion of the contract is German.

12. online dispute resolution

Online dispute resolution pursuant to Art. 14 (1) ODR Regulation: The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/.
We are neither willing nor obligated to participate in any out-of-court arbitration proceedings before a consumer arbitration board.

14 Cancellation policy

Below you will find instructions on the prerequisite and consequences of the statutory right of withdrawal for mail orders.

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods. by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached model withdrawal form for this purpose, which is, however, not mandatory. In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the goods. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

For revocation within Germany: Up to a value of goods of € 300.00 you bear the cost of returning the goods. After receipt of your written revocation you will receive from us the return instructions including return address. From a value of goods of 300,00 € we will pick up the goods or alternatively send a return parcel slip. We bear the cost of returning the goods provided that the goods are picked up by us or the return parcel slip sent by us is used.
For revocation from countries of the European Union: You bear the cost of returning the goods.
The right of withdrawal does not apply to consumers who do not belong to a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union.

You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.
